1. About these terms

These terms form a binding agreement between you and AMERICAN FOXHOUND CO LLC, a company operating in the United States at 11124 N 6000 W, Highland - 84003-9438, United States (US). They apply to every visitor to the website and to every club, handler, judge, steward, and guest who uses the grounds.

These terms work together with our Privacy Policy, which explains how we handle personal information, and with any written booking confirmation that we send to you. If there is a conflict between these terms and a written booking confirmation, the booking confirmation will take priority for the specific booking to which it relates.

Nothing in these terms limits any right that the law gives you and that cannot be excluded by agreement. If any part of these terms is found to be invalid or unenforceable, the rest of the terms will continue to apply.

2. Definitions

In these terms, the Company means AMERICAN FOXHOUND CO LLC. The grounds means the trial grounds and training grounds at 11124 N 6000 W, Highland - 84003-9438, United States (US), together with the kennel run, the trail bay, the hunt bench, the parking apron, and every lane and path on the property. A booking means a confirmed reservation for a trial day, a training run, or any other service. A club means an organisation that makes a booking or attends the grounds. A handler means a person who handles a hound on the grounds. A steward means a person appointed by the Company or by a club to keep the order of a trial day.

A trial day means a day on which a sanctioned or informal trial is held on the grounds. A training run means a booked session for conditioning or introductory work. The website means every page published at americanfoxhound.autos.

3. Use of the website

We provide the website so that clubs and handlers can learn about the grounds, read about our services, and get in touch. You may use the website for lawful purposes only. You must not use the website in a way that damages it, interferes with its operation, or prevents anyone else from using it.

You must not attempt to gain unauthorised access to any part of the website or to any system connected to it. You must not submit information through the website that is false, misleading, or intended to deceive. You must not use the contact form to send spam, abusive content, or material that infringes the rights of another person.

We may change, suspend, or withdraw any part of the website at any time. We do not guarantee that the website will be available without interruption, and we are not responsible for any loss caused by a period in which the website is unavailable, except where the law requires otherwise.

4. Booking a trial day or training run

You may request a booking through the contact page, by email, or by telephone. A request is not a booking until we confirm it in writing. We answer every request within one working day where possible, and we will tell you if the date that you have asked for is not available.

When you request a booking, please give us the name of the club, the preferred date and time, the kind of day that you have in mind, and an estimate of the number of entries. If you are unsure whether you need a trial day or a training run, tell us and we will suggest the arrangement that fits your entry.

We keep the grounds to a small number of bookings each week so that the lanes are not worn and the run is properly cleaned between clubs. Because of this, popular dates fill early. If a date is already taken, we will offer the nearest alternatives and explain what each one changes about the day.

We may decline a booking where the requested use is not suitable for the grounds, where the safety of people or hounds would be put at risk, or where the club has not met its obligations under an earlier booking.

5. Confirmation and payment

Our written confirmation sets out the date, the arrival time, the services that have been booked, the fee, and any conditions that apply to the booking. The confirmation is the basis of the agreement for that booking, and you should check it carefully. If anything in the confirmation is wrong, tell us promptly so that we can correct it.

Fees are payable in the manner set out in the confirmation. Where a deposit is required, the booking is held only once the deposit has been received. Where the balance is payable before the day, the booking may be released if the balance is not received by the date set out in the confirmation.

All fees are stated in United States dollars unless the confirmation says otherwise. Any tax that applies will be shown on the confirmation or on the invoice. We may review fees from time to time, but a fee that has already been confirmed for a booking will not change for that booking.

6. Cancellation and rescheduling

We understand that plans change and that ground conditions can be uncertain. The following arrangements apply unless a different arrangement is set out in your confirmation.

If you cancel a booking more than fourteen days before the day, we will refund any deposit paid or transfer it to a new date at your request. If you cancel between fourteen and seven days before the day, we may retain part of the deposit to cover the work that has already been done, such as the lane set and the assignment of stewards. If you cancel less than seven days before the day, we may retain the whole deposit.

If we cancel a booking because the ground is not fit to run, or because of an event outside our control, we will offer a new date or a refund of any amount paid for the cancelled day. We will tell you as soon as we can, and we will explain what has happened to the ground.

If a trial day has to be stopped after it has begun because of weather, a safety concern, or another serious reason, we will discuss the fairest outcome with the club, taking into account the work that has been done and the part of the card that has been run.

7. Grounds rules and conduct

Every person on the grounds must follow the reasonable directions of the Company and of the stewards. The grounds are a working environment for hounds, and conduct that disturbs hounds or interferes with a trial is not acceptable.

Vehicles must be parked on the gravel apron beside the trail bay, and trailers must keep the turning circle clear. Gates must be closed behind you. Litter must be taken away or placed in the bins provided. Smoking is not permitted in the kennel run or the trail bay.

Visitors must keep to the marked areas and must not walk down a lane while a brace is running. Photographs may be taken in the public areas of the grounds, but a person must not obstruct a steward or a judge in order to take a photograph. Drones may not be flown over the grounds without written permission.

Any person who does not follow these rules may be asked to leave the grounds. If a club repeatedly fails to keep these rules, we may decline future bookings from that club.

8. Use of the kennel run

The kennel run is provided so that hounds can wait in safety between braces. Each pen has a solid lower panel and open upper rails. Hounds must be secured when they are in a pen, and a handler must remain close enough to attend to a hound that becomes distressed.

The run is swept and disinfected between bookings, and the drain is checked as part of every trial day setup. Water is available at both ends of the run, and shade cloth is set out through the warm months. Clubs are asked to leave the run in the condition in which they found it.

The Company is not responsible for a hound that is left unattended in the run, and it is not responsible for a hound that escapes because a handler has not secured a gate or a lead. Handlers remain responsible for their hounds at all times.

9. Scent line setup

Where a club books a scent line setup, we agree the line length, the direction, the age of the line, and the position of the flags before the ground is closed. The club is responsible for telling us about any requirement that applies to its trial, such as the distance between casts or the order in which the lines are to be laid.

We lay the line in the manner agreed. If a club wishes to change the plan after the ground has been closed, we will do what we can, but we cannot guarantee that a late change will be possible on the day. A late change may attract an additional fee where it requires extra work or a delay to the card.

The club is responsible for making sure that its handlers understand the line that has been laid. We are not responsible for a result that follows from a handler misunderstanding the plan that the club approved.

10. Judges and steward support

Where a booking includes judges and steward support, we supply stewards to keep the card moving and to hold the paperwork in order. The stewards marshal the field, record times, hold the finish, and keep the rosette board. They do not decide the merit of a hound, which remains the responsibility of the judge appointed by the club.

Stewards arrive early enough to walk the field before the first brace. They follow the directions of the club and the judge, provided that those directions are consistent with safety and with the rules of the trial. A steward may stop a brace if the safety of a hound or a person is at risk.

The club is responsible for appointing its judges and for making sure that the judges are qualified for the trial that is being run. The Company does not act as a judge unless it is expressly engaged to do so in the confirmation.

11. Club season passes

A club season pass holds a set number of trial days and training runs across the calendar year. The pass sets out the number of days, the services that are included, the period for which the pass is valid, and the fee. The pass is issued to a named club and may not be transferred to another club without our written agreement.

Days held under a pass must be booked in advance and are subject to availability. A pass does not guarantee a particular date, but it does give the club priority over new requests for the same date. Unused days do not carry over to the following year unless the pass says so.

We may suspend a pass where a club has failed to pay its fee, has repeatedly broken the grounds rules, or has acted in a way that puts the safety of people or hounds at risk. Where a pass is suspended, we will explain our reasons in writing and give the club an opportunity to respond.

12. Grounds maintenance days

Grounds maintenance days are scheduled to keep the mown lanes true, the fences tight, and the kennel run drained. Clubs may join a maintenance day to learn how the field is prepared between trials, but the Company directs the work and decides what is safe for volunteers to do.

A person who joins a maintenance day does so at their own risk and must follow the directions of the Company. Tools and equipment remain the property of the Company. A volunteer must not operate machinery without express permission and instruction.

We may postpone a maintenance day because of weather or because the ground needs to be rested. We will give as much notice as we can, and we will offer a new date.

13. Hounds, welfare, and responsibility

The welfare of hounds is central to everything that happens on the grounds. Handlers must bring hounds that are fit to work, and they must not ask a hound to run a brace when it is injured, ill, or distressed. A steward may stop a brace where the welfare of a hound is in doubt.

Handlers are responsible for their hounds at all times, including their behaviour toward other hounds and toward people. Any incident must be reported to a steward as soon as it happens. The Company may ask a handler to remove a hound from the grounds where the hound presents a risk that cannot be managed.

Vaccination and health requirements set by a club or a governing body are the responsibility of the club and the handler. The Company does not inspect vaccination records unless the confirmation says that it will.

14. Limitation of liability

The grounds are an outdoor working environment, and attendance carries inherent risks that cannot be removed. These risks include uneven ground, changing weather, the behaviour of animals, and the presence of vehicles and equipment. Every person who attends the grounds accepts those risks as part of the activity.

To the fullest extent permitted by law, the Company is not liable for indirect or consequential loss, for loss of profit or reputation, or for loss that was not reasonably foreseeable at the time of the booking. Where the law does not allow the Company to exclude liability, its liability is limited to the fee paid for the booking in question.

Nothing in this section limits the liability of the Company for death or personal injury caused by its negligence, for fraud, or for any other liability that the law does not allow to be excluded.

15. Indemnity

A club agrees to indemnify the Company against any claim, loss, or expense that arises from the acts or omissions of the club, its handlers, its guests, or its hounds while on the grounds, except to the extent that the loss was caused by the negligence of the Company.

This indemnity includes the reasonable cost of defending a claim and of repairing damage to the grounds, the fences, the kennel run, or the trail bay. The Company will tell the club promptly about any claim that it receives and will give the club a reasonable opportunity to respond.

16. Intellectual property

The website, its text, its layout, and its design are owned by the Company or used under licence. The name AMERICAN FOXHOUND CO LLC and the design of the grounds as presented on the website are protected by the rights that apply to them.

You may read, print, and share the pages of the website for your own use and for the use of your club in considering a booking. You must not copy the website for a commercial purpose, republish it, or present it as your own work without written permission.

17. Privacy and data

Our Privacy Policy explains how we collect, use, and protect personal information. By using the website or making a booking, you agree that we may handle your information in the manner described in that policy.

Where a club supplies information about its handlers, the club is responsible for making sure that those people know that their information has been passed to us and for obtaining any consent that the law requires. The Company handles that information in accordance with the Privacy Policy.

18. Events outside our control

The Company is not liable for a failure or delay in performing its obligations where the failure or delay is caused by an event outside its reasonable control. Such events include severe weather, flooding, fire, power failure, illness among staff, civil disturbance, and any action of a public authority.

Where such an event affects a booking, we will tell the club as soon as we can, and we will offer a new date or a refund in accordance with the section on cancellation and rescheduling.

19. Governing law and disputes

These terms are governed by the laws of the State of Utah and of the United States, without regard to conflict of law rules. Any dispute that cannot be resolved by discussion will be dealt with by the courts that have jurisdiction over the Company and the grounds.

Before beginning formal proceedings, we ask that you contact us so that we can try to resolve the matter directly. Most concerns can be settled quickly once the facts are clear. If a dispute concerns a booking, please include the confirmation, the date, and a short description of what went wrong.

20. Changes to these terms

We may update these terms from time to time to reflect changes in the way that we work, in the services that we offer, or in the law that applies to us. When we make a material change, we will update the date at the top of the page and, where appropriate, tell clubs and handlers who have an active booking.

The terms that apply to a booking are the terms that were published at the time the booking was confirmed, unless the law requires otherwise. The version published on this page is the current version for all new bookings.
